Pakistan and Australia Move Closer to Investment Deal

Pakistan and Australia have made significant headway toward finalizing a Bilateral Investment Treaty (BIT) designed to promote foreign direct investment (FDI) and protect the regulatory interests of both countries. After a two-day virtual round of technical talks, officials from both nations agreed on most of the treaty’s core provisions, though the draft remains confidential and subject to further review.

Key Provisions in the Draft Bilateral Investment Treaty

The objects of the treaty are to cover a sound body of law dealing with international investments that give insight into the fair and equitable treatment, protection against seizure, and the free movement of investment returns. It also signifies the significance of sustainable growth, openness, and duty of company to world investment.

Safeguarding Sovereignty and Regulatory Space

One of the main points in the draft treaty is to explicitly reassert a right to regulate on the public interest side, by each country. Pakistan and Australia have their freedom to take health, environmental and social welfare measures and therefore the flexibility of use of policy will go on even when it is proposed to invest.

Fair Compensation, Profit Repatriation, and Investor Obligations

The agreement guarantees that expropriation of investments should be made under legal terms and condition with proper, timely and reasonable compensation to the investors who get affected. Investors will have the freedom of transferring profits, capital, and other returns in usable currency but this may be limited by the need to maintain financial stability in the country. Notably, the treaty contains standards that all investors should adhere to in the form of anti-corruption, environmental and social accountability.

Commitment to International Standards and Next Steps

There is also a proposal of a multi-tiered dispute resolution process. It starts with consultations through a Joint Committee after which it proceeds to domestic remedies and can even end up in international arbitration in case of need. The treaty is also based on international best practices and standards as it cites the UN Sustainable Development Goals, the UN Guiding Principles on Business and Human Rights, and OECD guidelines. The governments of both countries are going over the text and more negotiations and legal clearance will be followed, before any official signing and implementation.

After it is complete, the Pakistan-Australia BIT promises to establish a new investment agreement standard in the region that is based on finding the balance between the rights and interests of investors and the policy and national sovereignty concerns of both governments. The stakeholders and the investors have been encouraged to watch progress as the two parties get closer to authorization.
