Islamabad High Court Bars FBR from Taking Strict Action over Capital Tax Recovery

February 21, 2025Zayn0

The Islamabad High Court has passed a landmark order restraining the Federal Board of Revenue from taking coercive action against property owners in the Islamabad Capital Territory for the recovery of Capital Value Tax. With this decision, many property owners were relieved from the burden of some possible penalties.

Legal Background

As stated in the IHC order, notices have been served to the Federation, which included the Attorney General of Pakistan and the FBR. The court ordered that till the decision of this petition no coercive measures shall be adopted against the petitioners related to the tax levied. The concern for the legality of imposition is developing.

Petition against Tax Provisions

The petitioners are contending the unconstitutionality of certain sections of Finance Act, 2022 as amended by Act 2024. They contend that the amendments have violated Articles 23, 24, and 25 of the Constitution as well as Entry No. 50 of Part-I of the Federal Legislative List in the Fourth Schedule. The IHC has stated that the petition shall be heard jointly with another case having similar issues, in order to ensure uniformity in the judicial process.

The Controversial Capital Value Tax

The grievance of the petition mostly seems to revolve on the imposition of a Capital Value Tax on farmhouses of at least 2,000 square yards and residential houses of at least 1,000 square yards. This tax is enacted on the basis of size and not on any economic activity associated with the property. The petitioners argue that this is unlike normal CVT practice, which traditionally precedes that tax with an economic transaction, namely the sale or purchase of assets.

Taxation Concerns

Tax experts argue that while this is being called a Capital Value Tax, the Impugned Levy has no direct connection to any economic transaction. The underlying rationale of the tax is mere size; this, in the opinion of the petitioners, is fairly a tax on immovable property, which the Federation cannot levy due to the constitutional amendments placing limits on these powers.

Implications for Property Owners

The order very much affects Islamabad homeowners who find themselves potentially financially burdened by CVT. As the case proceeds, many will be closely watching how the court deals with the legality of a tax and its enforcement by the FBR. This will be an important setting for tax policy and property rights in Pakistan.
