The federal government has notified new Health Allowance rules, limiting eligibility to staff directly involved in patient care and aligning payments with a Supreme Court ruling.
Only Staff in Direct Patient Care Will Get Health Allowance
The federal government has issued fresh rules for the payment of Health Allowance to medical staff, making it clear that only employees directly involved in patient care will be eligible. According to a new office memorandum from the Ministry of Finance, the allowance will be restricted to federal employees who provide hands-on, practical services in the treatment and care of patients.
This means that doctors (medical and dental), allied specialists, pharmacists, nurses, paramedics and other supporting staff who work directly with patients can qualify for the allowance. By contrast, officials and employees who are not engaged in day-to-day patient care will no longer be covered under this facility, even if they work in the health sector or are posted in hospitals and related institutions.
Supreme Court Ruling Forms the Basis of New Policy
The revised rules are based on a landmark decision by the Supreme Court of Pakistan, issued on 4 July 2024 in Case No. C.A. 302/2024 to 315/2024 (Federation of Pakistan vs. Ehsan Ullah, etc.). In that judgment, the Supreme Court clearly defined what counts as healthcare service delivery for the purpose of special allowances and other benefits.
The court described direct healthcare services as tasks that involve receiving patients, examining them, providing treatment, delivering bedside care and dealing with their medical problems in real time. Employees whose work matches this definition are considered part of the frontline care team.
By tying the Health Allowance rules to the Supreme Court’s interpretation, the federal government has effectively closed the door to broader or vague claims from staff who do not deal with patients directly. The Ministry of Finance has stated that, with the Prime Minister’s approval, the allowance in federal departments will be paid strictly in line with this judicial guidance.
Who Is Eligible and Who Is Not
Under the new framework, the eligible categories include doctors from all clinical specialties, dental surgeons, allied health professionals, pharmacists, staff nurses, midwives, paramedics and other support workers who are physically present in wards, emergency rooms, operating theatres, laboratories and clinics where patients are examined and treated.
On the other hand, employees who work in purely administrative, managerial, clerical or back-office roles will not be entitled to the Health Allowance. This applies even if they are posted in hospitals, medical universities, attached departments or health-related projects but do not perform direct clinical duties. The memorandum states clearly that individuals not engaged in direct patient care are excluded from the benefit.
This clarification is meant to end confusion and disputes about who can claim the allowance, and to ensure that the financial support is focused on staff who face the highest health risks and workload while treating patients, especially in critical care and emergency settings.
Payment, Tax Treatment and Leave Rules
The Ministry of Finance has also clarified how the Health Allowance will be treated in payroll and leave calculations. First, the allowance will be subject to income tax, meaning it will be included in taxable income and taxed under normal rules.
Second, the allowance will be payable during regular leave and during Leave Preparatory to Retirement (LPR), so eligible employees will continue to receive it while they are on these types of sanctioned leave. However, the allowance will not be paid during extraordinary leave, which usually covers long absences without full pay.
The circular further states that the Health Allowance will not count for pension, gratuity or house rent deduction purposes. In other words, it will not be treated as part of “pensionable emoluments” when calculating retirement benefits, and will not be used to determine house rent recovery or related deductions. This keeps the allowance separate and clearly defined as a current, non-pensionable benefit tied to active involvement in patient care.
Implementation Timeline and Next Steps for Departments
To ensure quick implementation, all federal accounts offices have been directed to complete the necessary adjustments within 15 days and submit compliance reports. This includes verifying which employees meet the criteria for direct patient care, updating payroll records, and removing ineligible staff from Health Allowance lists where required.
For doctors, nurses, pharmacists, paramedics and other clinical staff, the new rules confirm that their frontline role is recognised through a dedicated allowance, but strictly under the conditions laid down by the Supreme Court. For administrators and non-clinical employees, the circular sends a different message: benefits linked to health risk and patient contact will only be reserved for those who are physically involved in treatment and care.
Overall, the new Health Allowance policy aims to create a more disciplined and legally compliant framework, reduce disputes over eligibility and ensure that limited public funds are directed towards the medical teams who face the highest exposure while serving patients in federal health facilities across Pakistan.
